1. Basics to File Complaint:

A person(s) can file a complaint against the Promoters, Allottees and/or Real estate agents under Section 31 of the Real Estate (regulation and development) Act, 2016 to the Real Estate Regulatory Authority or the adjudicating officer.

To lodge a complaint, the complainant is required to fill the prescribed form available with the authority which has been designed by all State Governments and UT’s [Union Territories] differently. Like in the case of Chandigarh a [Union Territory] and Uttar Pradesh an adjoining state to the national capital city Delhi have the forms the denoted with ‘M’ and ‘N’.

2. Who can File Complaint under RERA Act?

Any person(s) who invested in a certain property has the right to file a complaint related to the developer/builder with the RERA Authority. Also, a complaint can be filed online by visiting the state RERA website like up-rera.in/.

3. Documents Required to File Complaint:

  • Personal details of both the Complainant and the Respondent

  • Project’s RERA Registration number

  • Project’s Address

  • A Brief Report of Facts & Grounds of Claim

4. Transfer of Property-Pending Cases:

Many complainants file a property related issue against the Developer/Builder/Real Estate agent in the National Consumer Disputes Redressal Commission [NCDRC] as they remain unaware of the RERA authority which works to deal with any issue related to the same and hence the huge number of piled up cases in consumer court makes you wait long for results.

So, transfer the case from National Consumer Disputes Redressal Commission [NCDRC] to the RERA authority as this body ease the process and help you get relief under Sections 12, 14, 18 and 19 of the RERA Act. To transfer a case, the complainant has to withdraw the same from NCDRC before appealing to the RERA authority to look into the matter.

5. Timeframe for Resolving Dispute under RERA:

No particular timeframe is set for resolving issues related to the complaints filed with the RERA authority but the action is promised to be taken at the earliest in accordance with the time at which the complaint has been lodged. The authority works in accordance to the structure predefined in a Limitation Act 1963.
